Welcome to AltitudeNow
Welcome to AltitudeNow (the "App" or "we")!
These Terms of Service (the "Agreement") are a legal agreement between you ("User" or "you") and the AltitudeNow development team regarding your use of the App.
Please read and fully understand this Agreement, especially provisions that limit or exclude liability, dispute resolution, and governing law.
By downloading, installing, launching, or otherwise using the App, you acknowledge that you have read, understood, and agreed to be bound by this Agreement in its entirety. If you do not agree with any part of this Agreement, please stop using the App immediately.
1. Definitions
1.1 Defined Terms
- AltitudeNow / the App: The mobile application "AltitudeNow" developed and operated by us, including all features, services, and content.
- User / you: Any individual who downloads, installs, uses, or browses the App.
- Summit card: A shareable image or exported file created through the App's camera, theme Pin, or generation features, with altitude, place, time, and other information overlaid.
- Track card: A shareable image or exported file synthesized from route data and activity metrics after track recording ends.
- Arrival record: A local record created in the App each time you capture, Pin-mark an arrival, or save a summit card, including altitude, place, time, thumbnail, and related activity metrics.
- Track record: A local record saved after you finish track recording, including route coordinates, distance, duration, speed, card image, and related data.
- Summit Passport: A Pro membership feature that aggregates and displays a map view of visit points from your historical summit and track records on your device.
- Pro membership: In-app subscription or one-time purchase plans purchased through app stores to unlock extended features.
- Content: Any information, data, text, images, or other materials you create, capture, generate, save, or share while using the App.
- Services: All features and services provided by the App, including but not limited to real-time altitude display, compass, summit camera, track recording, card generation and export, record management, Summit Passport, Pro membership, and settings.
2. Services
2.1 Service Description
AltitudeNow is an outdoor check-in and summit commemoration tool centered on "the moment you arrive." It mainly provides the following services:
- 1. Real-time altitude and place display
- Display current altitude based on device GPS (supports meters/feet switching)
- Display human-readable place text when signal is available (such as landmarks or area names)
- Provide clear status prompts when accuracy is insufficient or signal is weak
- Display barometric pressure and estimated oxygen content on supported devices
- 2. Compass
- Full-screen compass displaying bearing, latitude and longitude, and current altitude
- 3. Summit camera and card generation
- Full-screen camera preview, or switch to a theme gradient background for one-tap Pin
- Overlay altitude, place, time, pressure, and other information
- Multiple summit card templates
- Combine captured or generated results into shareable summit cards
- 4. Track recording
- Full-screen map showing current location, heading, and live route
- Start/pause/resume/end recording with distance, speed, and duration statistics
- Location may continue in the background while recording is in progress (the exact mechanism depends on your device system, such as background location or a foreground service notification)
- Generate a track share card after recording ends
- 5. Card export and sharing
- Preview generated results
- Save images to the device photo library (requires your authorization or follows platform rules)
- Share to social platforms or other apps through the system share feature
- 6. Record management
- View historical summit records and track records on a timeline
- View details for individual records
- Persist records locally on the device and support deletion
- 7. Summit Passport (Pro)
- Map overview of summit/place Pins you have visited
- Aggregate visit points from summit records and track records
- 8. Settings and auxiliary features
- Altitude units, track distance units, language, haptic feedback, and more
- Track map theme switching
- Summit theme color selection
- Version update detection
- Obtain weather summaries and related environmental information over the network when needed (with fallback when unavailable)
- Access to legal documents (Privacy Policy and Terms of Service)
2.2 Service Characteristics
- Local-first: Arrival records, track records, summit/track cards, and related data are stored on your device by default
- No registration required: Core features can be used without creating an account
- Offline capable: Altitude and GPS-related features work without a network; features that depend on the network such as reverse geocoding, weather queries, and map loading may degrade or become unavailable
- Free + Pro: Core features are free to use (with certain quota limits); Pro membership unlocks Summit Passport, unlimited tracks, unlimited captures/Pins, all theme colors, all card templates, and other extended features. See §2.4
- Membership benefits are channel-specific: Pro benefits are tied to the purchase channel and do not automatically carry over across different app stores or devices
2.3 Service Changes
We reserve the right to modify, suspend, or terminate part or all of the services at any time without prior notice. We will try to notify you of material changes through app updates or other means.
2.4 Pro Membership and Payments
2.4.1 Paid Plans
The App offers Pro membership, including but not limited to:

Specific prices are shown on the app store page you use. Payment is processed by app store providers such as Apple or Google.
2.4.2 Free Tier Quotas (Reference)
Free users can use core features, but some capabilities are subject to quota limits, such as:
- Summit captures/Pins: limited total count
- Track recording: limited number of savable tracks
- Theme colors: only some colors available
- Card templates: only some templates available
- Summit Passport: not available
Specific quotas are shown in the App and defined in configuration files. We may reasonably adjust them and explain changes in the App.
2.4.3 Subscription Terms
- Auto-renewal: Subscriptions automatically renew within 24 hours before the end of the current period unless you cancel at least 24 hours before the period ends
- How to cancel: Manage subscriptions in the app store account settings where you made the purchase (such as Apple Settings → Apple ID → Subscriptions, or Google Play Subscriptions)
- Trial: If you start a free trial and do not cancel before it ends, it will automatically convert to a paid subscription
- Restore purchases: Use the in-app "Restore Purchases" feature to restore purchased benefits (requires the same store account used for purchase)
- Refunds: Refund requests must be submitted to the relevant app store; we will comply with its refund policy
- Purchase channel: Pro purchased in one app store does not automatically take effect in another app store or on another device
2.4.4 Price Changes
We reserve the right to adjust Pro membership prices. The effect of price changes on existing subscriptions follows Apple or Google platform rules.
3. User Accounts and Rules of Use
3.1 Eligibility
- You must be at least 13 years old to use the App
- If you are under 18, you should use the App with the consent and supervision of a parent or guardian
- When purchasing Pro membership or making in-app transactions, you must have the corresponding legal capacity or have obtained guardian consent
3.2 Account Security
The App currently does not require account registration, but you are responsible for:
- Protecting your device from unauthorized access
- All activities that occur on your device
- Taking steps to protect your data if your device is lost or stolen
- Safeguarding your Apple ID or Google account to prevent unauthorized purchases
3.3 Acceptable Use
When using the App, you agree:
3.3.1 You shall
- Comply with applicable laws and regulations of the People's Republic of China and the laws applicable in your region
- Comply with this Agreement and related rules
- Use the App's features and services lawfully and properly
- Respect the intellectual property and privacy rights of others
- Pay attention to personal and environmental safety in outdoor or location-dependent scenarios, and avoid operating the device while walking
- While track recording is in progress, understand and accept that the device system may require background location authorization or persistent notifications
3.3.2 You shall not
- Use the App for any unlawful or improper conduct
- Rely on altitude, place, track, or card information displayed by the App as the sole basis for professional mountaineering, navigation, rescue, or scientific measurement
- Falsify or tamper with GPS, track, or card arrival information to deceive others or third parties
- Interfere with or disrupt the normal operation of the App
- Reverse engineer, decompile, or disassemble the App (except where permitted by law)
- Remove, hide, or alter any copyright, trademark, or other rights notices in the App
- Use automated tools, bots, or other means to access or use the App
- Distribute viruses, malicious code, or other harmful content
- Infringe the lawful rights and interests of others
- Use the App for any commercial purpose without our written permission
- Attempt to bypass Pro membership gates or free quota limits
4. User Content
4.1 Ownership of Content
- Photos you capture, summit/track cards you generate, arrival/track records, and other content you create belong to you (but interface elements, template designs, fonts, icons, and similar assets in the App remain owned by us or relevant rights holders)
- You are fully responsible for content you create and share
- We do not claim ownership of your photos or records
4.2 License to Us
When you create, save, or export content using the App, you grant us the following limited license:
- To store and process your content on your device in order to provide the services
- To access your content locally on your device when necessary to provide technical support or fix issues
Important notes:
- This license is limited to what is necessary to provide the services
- We will not use your content for advertising or unauthorized commercial purposes
- We will not sell your summit/track records or photos to third parties (except as required by law)
- When you delete content or uninstall the App, this license ends once the related data is deleted
4.3 Content Responsibility
You represent and warrant that:
- You have lawful rights to the content you create and share
- Your content does not infringe any third party's intellectual property, privacy, portrait, or other rights
- Your content does not contain illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise inappropriate material
- Your content complies with all applicable laws and regulations
If your content violates the above warranties, you bear full legal responsibility.
4.4 Content Backup
- You are responsible for backing up important content
- We recommend regularly saving summit/track cards to the photo library or backing up your device with system backup (such as iCloud Backup or Google Backup)
- We are not responsible for content loss caused by device failure, app errors, accidental deletion, system upgrades, or other reasons
5. Intellectual Property
5.1 App Intellectual Property
The App and all of its content (including but not limited to software code, interface design, icons, templates, text, images, audio, video, trademarks, and logos) are owned by us or relevant rights holders and are protected by the copyright, trademark, patent laws of the People's Republic of China and applicable international treaties.
5.2 License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the App on your personal device
- Use the App's features and services
- Create and export your own summit/track cards and records
This license does not include:
- Copying, modifying, adapting, or translating the App
- Selling, renting, transferring, or distributing the App
- Creating derivative works based on the App
- Using the App for any commercial purpose without our written permission
5.3 Third-Party Content
The App may use or link to services or content provided by third parties (such as Apple / Google system services, Google Maps, and open-source weather data APIs). Related rights and responsibilities are handled under each third party's terms and the disclaimers in this Agreement. We do not assume liability beyond what is required by law for third-party content or services.
6. Privacy Protection
6.1 Privacy Policy
We take your privacy seriously. For how we collect, use, store, and protect your personal information, please see our Privacy Policy.
The Privacy Policy is an integral part of this Agreement and has the same legal effect as this Agreement.
6.2 Data Security
We take reasonable technical and administrative measures to protect your data, but we cannot guarantee absolute security. You understand and agree that:
- The internet and mobile devices have inherent security risks
- You are responsible for taking measures to protect your device and data
- We are not liable for data leakage or loss caused by force majeure, hacking, virus intrusion, or similar events
7. Disclaimers
7.1 "As Is" and "As Available"
The App and its services are provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to:
- Fitness, accuracy, reliability, or completeness of the services
- That the services will be uninterrupted or error-free
- That the services will meet your specific needs
- That results obtained through the services will be accurate or reliable
7.2 Location and Altitude Data Disclaimer
The App uses device GPS, barometers (if available), compass sensors, and system geocoding services to provide altitude, place, and direction information. We are not responsible for:
- The accuracy, completeness, or timeliness of altitude, coordinates, place names, or heading
- GPS, barometric, or sensor deviations in indoor environments, canyons, urban canyons, or other obstructed conditions
- Related features being unavailable or limited in accuracy when a device lacks sensors such as a barometer
- Any loss or damage resulting from travel, mountaineering, camping, or other decisions made in reliance on App data
- The availability or interruption of location or related system services
Important notice: The App is designed to help you record and share "the moment you arrive." It is not a professional mountaineering navigation, surveying, or emergency rescue tool. Altitude, track, and place information is for reference only; you should make judgments based on actual conditions, professional equipment, and local regulations.
7.3 Track Recording Disclaimer
The track recording feature:
- May continue to obtain location in the background; the exact mechanism varies by platform
- Is affected by GPS signal, device performance, and battery level; routes may be incomplete or contain deviations
- May cause the device system to display notifications or status indicators during recording; this is a system mechanism and does not mean we upload your track to our servers
- We do not guarantee that track data is suitable for legal, insurance, competitive, or other formal purposes
7.4 Card Generation and Export Disclaimer
The quality and speed of summit/track card generation depend on many factors, including:
- Your device model and performance
- Whether camera and location permissions are granted
- Template complexity and selected image resolution
- Available system resources
We do not guarantee that every generation, save, or share will succeed, nor that exported files will display consistently on all platforms.
7.5 Third-Party Services Disclaimer
The App may integrate or call services provided by third parties or platforms (such as Core Location, Google Maps, the photo library, motion sensors, geocoding, weather data APIs, and in-app purchases). We are not responsible for the availability, accuracy, or reliability of third-party or platform services.
7.6 Pro Membership Disclaimer
- Pro membership benefits are subject to what is actually shown in the App and platform verification results
- We will try to assist if benefits are temporarily unavailable due to Apple, Google, account, or network issues, but we do not assume liability beyond what is required by law
- We reserve the right to adjust the scope of Pro features, but will not materially undermine reasonable expectations of users who have already paid
8. Limitation of Liability
8.1 Limitation of Damages
To the maximum extent permitted by law, we are not liable for:
- Any direct, indirect, incidental, special, punitive, or consequential damages arising from use of or inability to use the App
- Loss of profits, data, goodwill, or other intangible losses
- Any loss or damage caused by third-party services or content
- Any loss or damage caused by force majeure (such as natural disasters, war, strikes, or government actions)
- Personal injury or property damage resulting from failure to pay attention to environmental safety while using the App outdoors
8.2 Liability Cap
Even if we are found liable, our total liability shall not exceed the amount you paid for using the App or Pro membership in the past 12 months (if any). If you have not paid to use the App, this amount is zero.
8.3 User Indemnification
If we suffer any claim, lawsuit, loss, or damage because you violate this Agreement or because of your content, you agree to indemnify and hold us harmless, including reasonable attorney fees and litigation costs.
9. Service Interruption and Termination
9.1 Service Interruption
We may temporarily interrupt services for reasons including:
- System maintenance or upgrades
- Technical failures or network issues
- Force majeure events
- Legal or regulatory requirements
- App store review or policy changes
We will try to notify you in advance of service interruptions, but we cannot guarantee that we will be able to do so.
9.2 Service Termination
We reserve the right to terminate or suspend your use of the App if:
- You violate any provision of this Agreement
- You engage in illegal or improper conduct
- We believe continuing to provide the service poses legal risk
- We decide to discontinue the App
9.3 Effects of Termination
When your right to use the App is terminated:
- You must stop using the App immediately
- You must delete the App and all copies
- Provisions regarding intellectual property, disclaimers, limitation of liability, and similar matters continue to apply
- Cancellation and refunds for active Pro subscriptions follow the relevant app store policies
10. Changes to This Agreement
10.1 Right to Modify
We reserve the right to modify this Agreement at any time. When we make material changes, we will:
- Display a notice in the app
- Update the "Last Updated" date at the top of this document
- Describe the changes in the app store release notes
10.2 Effective Date of Changes
Revised terms take effect immediately upon publication. If you continue to use the App after changes take effect, you accept the revised Agreement.
10.3 If You Do Not Accept Changes
If you do not agree with the revised Agreement, you should:
- Stop using the App immediately
- Delete the App and all data
- Contact us to express your concerns
11. Dispute Resolution
11.1 Friendly Negotiation
If you have any dispute or complaint regarding the App or this Agreement, we encourage you to contact us first to seek a friendly resolution:

We will reply within 7 business days after receiving your email and will try to resolve the issue within 30 days.
11.2 Legal Proceedings
If a dispute cannot be resolved through friendly negotiation, you agree that:
- This Agreement is governed by the laws of the People's Republic of China (excluding its conflict-of-law rules)
- Any dispute shall be submitted to the competent people's court where we are located
- During dispute resolution, both parties shall continue to perform provisions of this Agreement that are not in dispute
12. Miscellaneous
12.1 Entire Agreement
This Agreement, including the Privacy Policy, constitutes the entire agreement between you and us regarding use of the App and supersedes any prior oral or written agreements.
12.2 Severability
If any provision of this Agreement is held invalid or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall remain in effect.
12.3 No Waiver
Our failure or delay in exercising any right or remedy under this Agreement does not constitute a waiver of that right or remedy.
12.4 Assignment
You may not assign any rights or obligations under this Agreement. We may assign our rights and obligations to any third party without prior notice.
12.5 Notices
We may send notices to you through:
- In-app notices
- System notifications (such as foreground service notifications while track recording is in progress)
- Push notifications (if enabled in the future and you have consented)
- Email (if you voluntarily provide it)
- App store release notes
You should send notices to us using the contact information provided in this Agreement.
12.6 Language
This Agreement is written in Chinese. If this Agreement is translated into other languages, the Chinese version shall prevail.

14. Special Statements
14.1 Non-Commercial Use
The App is primarily intended for personal, non-commercial use. If you wish to use the App for commercial purposes, please contact us for written permission.
14.2 Open Source Components
The App may use open source software components. Those components are governed by their respective open source licenses. We respect and comply with those license terms.
14.3 Export Control
You agree to comply with all applicable export control laws and regulations and not to export or re-export the App or related technology to restricted countries or regions.
